Noncompete Agreements
Many employers protect their intellectual property by requiring new employees to sign noncompete agreements (a type of restrictive covenant). A noncompete agreement generally limits the ability of an employee to use and share trade secrets, processes, customer lists and other confidential business information after he or she has left the company.
Our lawyers have extensive experience drafting, reviewing and negotiating noncompete contracts and can counsel you as to the enforceability and scope of your noncompete contracts. We also represent both employers and employees in legal disputes over noncompete agreements and other restrictive covenants.
New Georgia Laws
In the past, many noncompete agreements were found to be unenforceable if the court deemed they were unfair to the ex-employee. For instance, a noncompete could be thrown out because it didn't specify a geographic region. And if one part of the agreement was found to be invalid, the entire noncompete would be found unenforceable.
Due to changes occurring in the law during 2010, noncompete agreements will be evaluated differently by the courts. Because of the scope of these changes, it may be necessary to have existing noncompete agreements revised to protect your interests. We can review your situation to help you determine the best course of action.
